A $4 million potato chip class action lawsuit settlement awaits consumer claims. We've learned that Old Lyme Gourmet Co., maker of Deep River Snacks, faces legal action over allegations of misleading labels on their potato chips. As a result, eligible consumers can now claim compensation from this class action settlement.

Importantly, this case represents more than just another class action lawsuit. In fact, we're seeing increasing scrutiny of food packaging claims across the industry. We'll guide you through everything you need to know about this settlement, including eligibility requirements and how to submit your claim before the deadline.

Settlement Overview and Eligibility

The class action lawsuit against Old Lyme Gourmet Co. centers on allegations regarding misleading "non-GMO ingredients" labels on their potato chips. Specifically, customers who purchased Deep River brand potato chips between February 2, 2017, and December 6, 2024, are eligible for compensation. This is one of the class action settlements where no proof of purchase required, making it easier for consumers to participate.

We've found that the settlement offers two compensation tiers:

  • With Proof of Purchase: Customers receive $5 for first product and $0.50 for each additional product, with no limit on claims

  • Without Proof of Purchase: Customers receive $5 for first product and $0.50 for up to 10 additional products

Each household may submit only one claim form. Additionally, all claims must be for personal or household use rather than commercial use or resale purposes. The final approval hearing is scheduled for January 23, 2025.

To maintain validity, claims must be submitted by the July 28 deadline in 2025. Those who miss this deadline will forfeit their rights to receive benefits under the settlement.

Consumer Rights and Options

Settlement class members have several important rights and options to consider. We want to highlight that consumers can take one of three paths: file a claim, request exclusion, or object to the settlement.

For those choosing to file a claim, we must emphasize that all submissions require specific information, including:

  • Full name and contact details

  • Complete mailing address

  • Number of products purchased

  • Selected payment method

  • Signed declaration and date

Nevertheless, class members have the right to exclude themselves from the settlement by March 25, 2025. Meanwhile, those who wish to object to the settlement terms may do so by the same deadline while still remaining eligible for cash payment.

Those who choose to do nothing should understand the implications. By taking no action, class members will not receive any monetary payment and will give up their right to pursue separate legal action regarding these claims. Accordingly, class members should carefully consider their options. The settlement website offers both online claim form submission and downloadable PDF forms that can be mailed in.
